Subscription Conditions
These Subscription Conditions are entered into between you and Hyperionai Ltd if you are located in Europe, or Hyperionai Ltd if you are located in the United States. References to "we", "us", or "our" refer to the applicable entity based on your location.
1. Trial Period
We may provide a complimentary or paid trial subscription for the Service. If you do not cancel at least 24 hours prior to the conclusion of the trial within the timeframe specified at the point of purchase, the price displayed on the payment screen for your chosen subscription will be automatically debited.
2. Subscription Period
Your subscription will automatically renew at the conclusion of each billing cycle (based on the subscription option you chose when purchasing) unless you cancel.
3. Payment
Upon confirmation of your purchase, the applicable charges will be debited to the payment method you supplied at the time of purchase. You authorize us to charge the relevant fees to the payment method you have provided. If any payment is unsuccessful, we may attempt to process the payment again. During this grace period, you may retain access to the Service. If payment remains unsuccessful after this period, your subscription may be suspended or terminated.
4. Cancellation of Subscription
Cancelling your subscription will disable automatic renewal; however, you will retain access to all subscription features for the remainder of the current billing cycle. You may cancel a trial or subscription by reaching out to our support team or via the settings.
5. Modifications
To the fullest extent permitted under applicable law, we may alter subscription fees at any time. We will give reasonable prior notice of any pricing modifications by publishing updated prices in the app and/or sending an email notification, or via another prominent means. Any pricing modifications will take effect at the start of your next billing cycle following the notice period. Should you not wish to pay the revised fees, you may cancel the relevant subscription prior to the modifications coming into effect.
6. Reimbursements
To the extent permitted under applicable law, purchases made through our website are non-refundable and/or non-exchangeable, unless otherwise specified herein or mandated by applicable law. If you purchased your subscription through a third-party platform (such as the Apple App Store or Google Play Store), your purchase is subject to the refund policies of that platform, and any refund requests must be directed to the relevant platform provider.
7. How to Terminate Your Subscription
You may cancel your subscription at any time through the self-service cancellation function in your account settings: Account → Settings → Plan & Usage → Cancel subscription. Alternatively, you may contact our support team for assistance. We will process your cancellation promptly and without requiring you to take any additional steps beyond those necessary to identify your account and confirm your request.
8. Service Availability
We will use commercially reasonable efforts to make the Service available to you. However, you acknowledge that the Service may be subject to interruptions, including for maintenance, upgrades, or circumstances beyond our control. We will endeavor to provide advance notice of any scheduled maintenance that may affect Service availability. To the fullest extent permitted under applicable law, we shall not be liable for any loss or damage arising from any interruption or unavailability of the Service.
NOTICE FOR EU RESIDENTS
If you are a user in the EU, you have a 14-day period to withdraw from a contract without providing any reason and without bearing any costs.
Subject to the provision above, to exercise your withdrawal right, you must notify us of your decision to withdraw from this contract by email. You may utilize the model withdrawal form, though it is not compulsory. To satisfy the withdrawal deadline, it is sufficient to send your communication concerning the exercise of your withdrawal right before the withdrawal period expires.
Should you withdraw from this contract, we will refund all payments received from you. The refund will be processed without undue delay and in any case no later than 14 days from the date we are notified of your decision to withdraw from this contract. We will issue the refund using the same payment method as used for the original transaction, unless you have expressly agreed otherwise. In any event, you will not incur any charges as a consequence of the refund.
If you have been presented with and have given your prior express consent to commence performance during the withdrawal period, and have acknowledged that you will forfeit your withdrawal right, then (unless the Service is defective) you will not be entitled to a refund in relation to digital content and will only be entitled to a proportionate refund in relation to digital services. If this provision applies, we will furnish you with a copy of the confirmation of your prior express consent and acknowledgement on a durable medium.
